1. ABOUT THIS DISCLOSURE
This page explains how our Founding Member Program works, including benefits, requirements, and important information you should know before joining.
By signing up for the Founding Member Program, you acknowledge that you have read and understand this disclosure.
For complete terms that become binding when you create an account or make a purchase, please see our Terms of Service and Privacy Policy.
2. PROGRAM OVERVIEW
The Dance Store Founding Member Program offers exclusive lifetime benefits to our first 5,000 members. The program has three tiers based on signup order:
- Principal: First 1,000 members
- Spotlight: Members 1,001–2,500 (1,500 total spots)
- Center Stage: Members 2,501–5,000 (2,500 total spots)
After 5,000 members join, the Founding Member Program closes permanently. These benefits will never be offered again.
3. TIER BENEFITS

4. ACTIVE CUSTOMER REQUIREMENT
4.1 Definition of "Active Customer"
"Lifetime" benefits are available as long as you remain an active customer. An active customer is defined as someone who makes at least one purchase every 6 months.
Example:
- Make a purchase on January 15, 2026
- You remain active until July 15, 2026 (6 months)
- Make another purchase before July 15, 2026
- Your active status continues for another 6 months from that purchase date
4.2 What Constitutes a "Purchase"
For active status purposes, a qualifying purchase:
- Must be at least $10 (before shipping and taxes)
- Must be a completed, paid order
- Cannot be canceled or fully refunded
Does NOT count as a purchase:
- Gift card purchases alone
- Orders that are canceled before shipping
- Orders that are fully refunded
4.3 If You Become Inactive
If you do not make a purchase for 6 consecutive months:
- Your Founding Member status becomes inactive
- You lose access to founding member benefits
- Standard loyalty program benefits apply instead
- You will receive email notifications before benefits are suspended
5. EMAIL COMMUNICATIONS & CONSENT
5.1 Email Address Requirement
To participate in the Founding Member Program, you must provide a valid email address. This is how we:
- Notify you of your tier assignment
- Send points expiration reminders
- Deliver birthday reward notifications
- Communicate program updates
- Provide early access to launches
5.2 Types of Emails You'll Receive
Transactional Emails (Cannot Opt Out):
- Founding Member tier confirmation
- Points expiration warnings (30 days before expiration)
- Birthday reward notifications
- Active status warnings (if approaching 6-month threshold)
- Program changes or updates
Marketing Emails (Can Opt Out):
- New product announcements
- Sales and promotions
- Early access opportunities
- Community updates
5.3 Your Responsibilities
You are responsible for:
- Providing an accurate, working email address
- Keeping your email address current
- Checking your email regularly (including spam/junk folders)
- Reading important program communications
We are not responsible if:
- Emails go to your spam/junk folder
- You don't check your email
- You provide an incorrect email address
- You miss important notifications due to your email settings
5.4 Updating Your Email
You can update your email address anytime in your account settings. Program communications will be sent to your most current email on file.
6. ACCOUNT SECURITY & RESPONSIBILITY
6.1 Your Responsibilities
You are responsible for:
- Creating and maintaining a secure password
- Keeping your login credentials confidential
- Not sharing your account with others
- All activity that occurs under your account
- Notifying us immediately if your account is compromised
6.2 Account Sharing
One account per person. You may not:
- Share your account credentials with others
- Allow others to use your Founding Member benefits
- Create multiple accounts to obtain multiple Founding Member tiers
Violation of this policy may result in account suspension or termination.
6.3 Compromised Accounts
If you believe your account has been compromised:
- Change your password immediately
- Email us at support@dance.store within 24 hours
- We will investigate and take appropriate action
Important: If your account is compromised due to your own actions (sharing password, falling for phishing, etc.), we are not liable for unauthorized purchases or point redemptions.
6.4 Suspicious Activity
We reserve the right to:
- Suspend accounts showing suspicious activity
- Require additional verification
- Investigate potential fraud or abuse
- Terminate accounts violating program rules
7. ACCOUNT CLOSURE & BENEFIT FORFEITURE
7.1 Voluntary Account Closure
If YOU choose to close your account:
- All loyalty points are immediately forfeited
- Any unused birthday rewards expire immediately
- Founding Member status is permanently lost
- You cannot reopen the account or transfer benefits
- No refunds or compensation for forfeited benefits
7.2 Termination by The Dance Store
We may terminate your account if you:
- Violate these program rules
- Engage in fraudulent activity
- Abuse the program or exploit system errors
- Create multiple accounts
- Engage in harassment or inappropriate behavior
If we terminate your account for cause:
- All points and benefits are immediately forfeited
- You may be banned from creating future accounts
- No refunds or compensation will be provided
7.3 No Cash Value
Founding Member benefits, loyalty points, and birthday rewards have no cash value. Upon account closure (voluntary or involuntary):
- You cannot request cash payment for forfeited points
- You cannot request refunds for "lost" lifetime benefits
- You cannot transfer benefits to another person or account
7.4 Inactive Status vs. Closed Account
Inactive status (no purchase for 6 months):
- Benefits suspended but account remains open
- Can be reactivated by making a purchase
- Points may expire per standard rules, but tier status preserved
Closed account:
- Permanent termination
- Cannot be reopened
- All benefits permanently forfeited
8. ELIGIBILITY & ENROLLMENT
8.1 Who Can Join
The Founding Member Program is open to:
- Individuals 18 years or older
- Minors (under 18) with parental consent
- Residents of the United States
- Anyone with a valid email address
8.2 Geographic Restrictions
The Founding Member Program is currently available only to U.S. customers. International customers may sign up for our email list but should understand that certain benefits (such as free shipping) may not apply to international orders.
8.3 One Membership Per Person
Each person is limited to ONE Founding Member account. You may not:
- Create multiple accounts to obtain multiple tiers
- Transfer your Founding Member status to someone else
- Sell or give away your Founding Member account
8.4 How to Join
- Visit dance.store and click "Become a Founding Member"
- Enter your email address
- You'll receive a confirmation email with your tier assignment
- Your tier is determined by your position in the signup queue
- Benefits activate when we officially launch (target: Q1 2026)
9. FOUNDING MEMBERS UNDER 18 YEARS OLD
9.1 Age Requirements
If you are under 18 years old and wish to become a Founding Member, you must have your parent or legal guardian complete a parental consent process.
Important: Only individuals 18 years or older may create accounts and make purchases on The Dance Store. If you are under 18, your parent/guardian must create and manage your account.
9.2 How It Works for Minors
- STEP 1: Sign up for the Founding Member waitlist using your email address
- STEP 2: Your parent or guardian must complete our Parental Consent Form
- STEP 3: Parent/guardian emails the completed form to: foundingmembers@dance.store
- STEP 4: We review the consent form and activate your account within 3–5 business days
9.3 Parental Consent Options
OPTION A: Download Our Parental Consent Form (Recommended)
- Download the official Parental Consent Form from our website
- Parent/guardian fills out all required fields
- Parent/guardian signs and dates the form
- Scan or photograph the completed form
- Email to: foundingmembers@dance.store
- Subject line: "Parental Consent – [Child's Name]"
OPTION B: Simple Email Consent
Your parent/guardian can send a consent email to foundingmembers@dance.store with:
Subject: Parental Consent for [Child's Full Name]
Email body:
I consent to my child [Child's Full Name, Date of Birth] participating
in The Dance Store Founding Member Program. I will be responsible for
all account activity and purchases.

9.4 Special Requirements for Children Under 13
If your child is under 13 years old, federal law (COPPA – Children's Online Privacy Protection Act) requires additional verification.
For children under 13:
- Parent/guardian completes the Parental Consent Form or email
- We send a verification link to the parent's email address
- Parent must click the verification link to confirm consent
- This provides "verifiable parental consent" as required by law
Information we collect from children under 13:
- Name (for account identification)
- Parent/guardian email (for all communications)
- Purchase history (for loyalty program management)
- Shipping address (for order fulfillment only)
We do NOT:
- Collect more information than necessary
- Sell or share children's information
- Use children's information for targeted advertising
- Send marketing emails directly to children under 13
Parents of children under 13 may:
- Review their child's personal information at any time
- Request deletion of their child's information
- Refuse further collection of their child's information
- Revoke consent and close the account

9.5 Account Management for Minors
Once parental consent is received and approved:
Parent/Guardian receives:
- All account-related emails
- Points expiration notifications
- Birthday reward notifications
- Order confirmations
- Program updates
Parent/Guardian is responsible for:
- All purchases and charges on the account
- Monitoring the child's account activity
- Redeeming loyalty points and rewards
- Managing account settings
- Ensuring child complies with program rules
Minors cannot:
- Make purchases without parental authorization
- Modify account settings without parental access
- Redeem rewards without parental permission
- Close or transfer the account
9.6 Who Can Make Purchases
Only individuals 18 years or older may complete purchases.
If you are under 18:
- Your parent/guardian must complete all purchases
- Payment methods must belong to your parent/guardian
- Your parent/guardian authorizes use of loyalty benefits
- Your parent/guardian is responsible for all charges
We reserve the right to cancel orders or suspend accounts if we believe a minor is making unauthorized purchases.
9.7 Processing Time for Parental Consent
We manually review all parental consent submissions to ensure compliance with child protection laws and program rules.
Please allow:
- 3–5 business days for consent form review
- Confirmation email once account is activated
- During high-volume periods, processing may take up to 7 business days

10. TIER ASSIGNMENT
Your Founding Member tier is determined solely by your position in the signup queue:
- Signups 1–1,000: Principal
- Signups 1,001–2,500: Spotlight
- Signups 2,501–5,000: Center Stage
- Signup 5,001+: Program closed – standard membership only
Important:
- Tier assignment is final and cannot be changed
- You cannot upgrade to a higher tier after signup
- Tier status remains for life (as long as you're an active customer)
- We assign tiers in the exact order signups are received
11. BENEFITS ACTIVATION
11.1 When Benefits Begin
Founding Member benefits activate on our official launch date (target estimate: Q1 2026).
Before launch:
- Your tier is reserved
- You'll receive pre-launch updates
- You cannot yet make purchases or earn points
After launch:
- All benefits become active immediately
- Free shipping applies to your first order
- Start earning 2X points (Principal/Spotlight) or standard points (Center Stage)
- Birthday rewards become available
11.2 Pre-Launch Period
During the pre-launch period:
- We'll email you progress updates
- You'll get sneak peeks of products
- You can provide input on what we carry
- Your spot in line is secure
12. LOYALTY POINTS SYSTEM
12.1 How Points Work
All customers (Founding Members and standard members) earn points on purchases:
- Standard Earning Rate: 5 points per $1 spent
Founding Member Bonus:
- Principal: 2X points (10 per $1) for first 12 months
- Spotlight: 2X points (10 per $1) for first 12 months
- Center Stage: 2X points (10 per $1) for first 6 months
After bonus period ends, all Founding Members earn standard 5 points per $1.
12.2 Points Earning
You earn points on:
- Product purchases (calculated on subtotal before shipping/tax)
- Points are awarded after order ships (not at time of purchase)
You do NOT earn points on:
- Shipping fees
- Taxes
- Gift card purchases
- Refunded or canceled orders
Example:
- Order: $100 in products
- Shipping: $7.99
- Tax: $8.50
- Total: $116.49

Points earned: 500 points (5 points × $100)
- OR 1,000 points if you're a Founding Member during bonus period (10 points × $100)
12.3 Points Redemption
Redeem points for discounts on future purchases:
- 250 points = $2.50 off
- 500 points = $5 off
- 1,000 points = $10 off
- 2,500 points = $25 off
- 5,000 points = $50 off
Redemption Rules:
- Minimum redemption: 250 points
- No maximum redemption limit
- Points applied to order subtotal (not shipping or tax)
- Must redeem points before placing order (cannot be applied retroactively)
12.4 Points Expiration
IMPORTANT: All loyalty points expire 12 months from the date they are earned.
How it works:
- Points earned on March 1, 2026 expire on March 1, 2027 at 11:59 PM PT
- You must redeem points before they expire
- Expired points are automatically removed from your account
- Expired points cannot be reinstated
Example:
- January 15, 2026: Earn 500 points
- January 15, 2027: Those 500 points expire
- March 20, 2026: Earn 1,000 points
- March 20, 2027: Those 1,000 points expire
Email Notifications:
- 30 days before expiration: Reminder email
- 7 days before expiration: Final warning email
- Day of expiration: Points removed from account
Your Responsibility:
- Check your points balance regularly
- Redeem points before they expire
- We are not responsible if you don't check your email
- Cannot make exceptions for expired points
12.5 Bonus Points Opportunities
Throughout the year, we may offer bonus point events:
- Double points days
- Triple points on specific products
- Bonus points for reviews
- Birthday bonus points
Founding Members get priority notification of bonus point events.
13. FREE SHIPPING BENEFITS
13.1 Free Shipping Thresholds
Founding Member Free Shipping:
- Principal: Free standard shipping on orders $25+
- Spotlight: Free standard shipping on orders $35+
- Center Stage: Free standard shipping on orders $45+
Standard Members (Non-Founding):
- Free standard shipping on orders $60+
13.2 What "Free Shipping" Includes
Free shipping covers:
- Standard ground shipping within the Continental United States
- Typical delivery: 5–8 business days
- Tracking provided for all orders
13.3 What "Free Shipping" Does NOT Include
Free shipping does NOT cover:
- Expedited or rush shipping (2-day, overnight, etc.)
- Alaska, Hawaii, or U.S. territories (may incur additional fees)
- International shipping
- P.O. Boxes requiring special handling
- Orders requiring signature confirmation
To receive free shipping:
- Order must meet your tier's minimum threshold
- Must select standard shipping at checkout
- Applies only to addresses in Continental U.S.
13.4 Free Shipping + Other Discounts
Good news: Your Founding Member free shipping benefit CAN be combined with:
- Discount codes and promo codes
- Site-wide sales
- Loyalty points redemption
- Birthday rewards

14. BIRTHDAY REWARDS
14.1 Birthday Reward Amounts
Annual birthday rewards:
- Principal: $50 reward with $125+ purchase
- Spotlight: $50 reward with $125+ purchase
- Center Stage: $25 reward with $75+ purchase
14.2 How Birthday Rewards Work
Automatic Delivery:
- Birthday reward automatically loads to your account on your birthday
- You'll receive an email notification when reward is available
- Reward appears as available credit in your account
- Must be logged in for reward to be issued
Expiration:
- Birthday rewards expire 30 days after your birthday
- Example: Birthday on March 15 → Reward expires April 14 at 11:59 PM PT
- Expired rewards cannot be reinstated or extended
- You'll receive reminder emails at 7 days before expiration
14.3 Birthday Reward Requirements
To use your birthday reward:
- Must meet the minimum purchase threshold for your tier
- Must use entire reward in a single transaction (cannot split across multiple orders)
- Account must be in good standing (not suspended or inactive)
- Must have provided accurate birth date
14.4 Birthday Reward Restrictions
Can be combined with:
- Founding Member free shipping benefit
Cannot be combined with:
- Discount codes or promo codes
- Loyalty points redemption
- Other birthday rewards from previous years
- Any other promotional offers
One reward per year:
- You receive ONE birthday reward annually
- Cannot stockpile unused birthday rewards
- If unused, reward expires and cannot be carried forward
14.5 Birthday Information
Providing Your Birthday:
- You must provide an accurate birth date when creating your account
- Birthday can only be changed once per year (to prevent abuse)
- Contact support@dance.store to update an incorrect birth date with verification
Verification:
- We may require ID verification for birthday updates
- This protects against abuse of the birthday reward system
14.6 Birthday Reward Examples
Example 1: Principal Member
- Birthday: June 1, 2026
- June 1: $50 reward loads to account
- June 30 at 11:59 PM PT: Reward expires (30 days)
- Must place order with $125+ minimum before June 30
- Can use free shipping on order (if order is $25+)
Example 2: Center Stage Member
- Birthday: December 15, 2026
- December 15: $25 reward loads to account
- January 14, 2027 at 11:59 PM PT: Reward expires
- Must place order with $75+ minimum before January 14
- Doesn't use it → Reward forfeited, cannot be reinstated
15. VIP EARLY ACCESS
15.1 What Early Access Means
Founding Members receive early access to:
- New product launches
- Limited edition items
- Seasonal sales
- Exclusive promotions
Access windows:
- Principal: 72 hours before public release
- Spotlight: 72 hours before public release
- Center Stage: 72 hours before public release
15.2 Early Access Is Not Guaranteed
Important disclosures:
- Early access is a benefit, not a guarantee
- We determine which launches qualify for early access
- Not all products will have early access periods
- Inventory during early access may be limited
- Products may sell out during early access
We do not guarantee:
- Product availability during your early access window
- That your size/color will be in stock
- Website performance during high-traffic events
- That technical issues won't prevent access
15.3 How Early Access Works
Email Notifications:
- We'll email you when early access begins
- Email includes special early access link
- Link is active only during your access window
Your Responsibilities:
- Check your email for early access notifications
- Act quickly during your access window
- We are not liable if you miss your window
16. RETURNS & REFUNDS IMPACT ON POINTS
16.1 Points Deduction on Returns
If you return items from an order, points earned on those items will be deducted from your account.
Example:
- Original order: $100
- Points earned: 500 points (or 1,000 if Founding Member during bonus period)
- You return: $50 worth of items
- Points deducted: 250 points (or 500 points)
- Your balance: 250 points remaining (or 500 points)
16.2 If You Already Spent the Points
If you already redeemed points from a returned order:
- Your point balance will go negative
- You must "repay" the negative balance before earning new points
- Future point earnings will offset the negative balance
Example:
- Order $100 → Earn 500 points → Redeem 500 points → Return $100 order
- Your balance: -500 points
- Next order $50 → Earn 250 points
- New balance: -250 points (still negative)
- Next order $50 → Earn 250 points
- New balance: 0 points (back to zero, can start earning again)
16.3 Birthday Rewards and Returns
If you used your birthday reward and then returned items:
- Birthday reward credit is reversed from your account
- If the order total falls below the minimum threshold after return, the birthday reward is forfeited
- Birthday rewards cannot be reissued once used, even if items are returned
17. PROMOTION STACKING RULES
17.1 What CAN Be Combined
Your Founding Member free shipping benefit CAN be combined with:
- Discount codes and promo codes
- Site-wide sales and promotions
- Loyalty points redemption
- Birthday rewards
Example:
Principal member places $30 order:
- Uses "SAVE20" discount code (20% off)
- Gets free shipping (order is $25+ after discount)
- Both benefits apply!
17.2 What CANNOT Be Combined
The following CANNOT be combined on the same order:
❌ Multiple discount codes
❌ Discount codes + birthday rewards
❌ Discount codes + loyalty points redemption
❌ Birthday rewards + loyalty points redemption
❌ Multiple birthday rewards from different years
Example:
You cannot use:
❌ "SAVE20" code + "WELCOME10" code on same order
❌ $50 birthday reward + 1,000 points ($10 off) on same order
❌ "SAVE15" code + $50 birthday reward on same order
17.3 One Discount Per Order Rule
General rule: Only ONE price reduction method per order
Choose one:
- Discount/promo code, OR
- Birthday reward, OR
- Points redemption
Plus: Your free shipping benefit (always applies if order meets threshold)
18. PROGRAM MODIFICATIONS
18.1 Our Right to Modify
We reserve the right to modify or discontinue the Founding Member Program at any time, including:
- Changes to benefits or perks
- Changes to points earning or redemption
- Changes to free shipping thresholds
- Changes to program rules
Notice Requirements:
- Material changes: 30 days advance notice via email
- Minor changes: Effective immediately, notification via email or website
What constitutes "material" changes:
- Removing or significantly reducing benefits (e.g., eliminating free shipping)
- Increasing minimum thresholds substantially
- Changing points expiration from 12 months to 6 months
What constitutes "minor" changes:
- Email timing or formatting
- Website interface updates
- Clarifications to existing rules
- Administrative process changes
18.2 Grandfathering Policy
For material changes that reduce benefits:
- Existing Founding Members will be notified 30 days in advance
- We will make reasonable efforts to grandfather existing members under original terms
- However, we reserve the right to apply changes to all members if necessary for business reasons
Example: If we increase Principal free shipping from $25 to $35, we will attempt to keep existing Principal members at $25 threshold, but reserve the right to apply the new $35 threshold to everyone if needed.
18.3 Continued Use = Acceptance
By continuing to use the Founding Member Program after changes are made:
- You accept the new terms
- You waive any objection to the changes
- The modified program terms become binding
If you do not accept the changes:
- You may close your account before changes take effect
- See Section 7 for account closure details
19. FRAUDULENT ACTIVITY & PROGRAM ABUSE
19.1 Prohibited Activities
The following activities are strictly prohibited and may result in account suspension or termination:
❌ Creating multiple accounts to obtain multiple Founding Member tiers
❌ Using stolen credit cards or payment information
❌ Exploiting system bugs or errors to earn extra points
❌ Reselling Founding Member accounts
❌ Filing false chargebacks or refund abuse
❌ Using bots or automated systems to manipulate the program
❌ Providing false information to obtain benefits
❌ Sharing accounts or credentials with others
19.2 System Errors
If you discover a system error that allows you to earn points or benefits incorrectly:
- You must report it to us immediately at support@dance.store
- You may not exploit the error for personal gain
- We reserve the right to correct your account balance
- Deliberate exploitation may result in account termination
19.3 Investigation
We reserve the right to:
- Investigate any suspicious account activity
- Request additional verification or documentation
- Temporarily suspend accounts during investigation
- Deduct incorrectly awarded points or benefits
- Terminate accounts found to be engaging in fraud or abuse
19.4 No Tolerance Policy
We have a zero-tolerance policy for fraud and abuse. Accounts found violating these rules will be immediately terminated with no refunds or compensation.
20. FORCE MAJEURE & SERVICE INTERRUPTIONS
20.1 Events Beyond Our Control
We are not liable for delays, failures, or inability to perform due to causes beyond our reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, fires, etc.)
- Cyberattacks or security breaches
- Internet or telecommunications failures
- Government actions or regulations
- Supplier issues or inventory shortages
- Pandemics or public health emergencies
- Labor disputes or strikes
- Acts of war or terrorism
20.2 Service Interruptions
During service interruptions or technical issues:
- Benefits may be temporarily unavailable
- Points earning may be delayed
- Website access may be limited
- Order processing may be affected
We will:
- Make reasonable efforts to restore service as quickly as possible
- Communicate about extended outages via email or social media
- Not penalize you for issues beyond your control (e.g., won't count toward 6-month inactive period)
We are not liable for:
- Lost points or benefits during outages
- Orders that cannot be placed during interruptions
- Missed early access opportunities due to technical issues
21. GEOGRAPHIC RESTRICTIONS
21.1 Free Shipping Geography
Founding Member free shipping applies to:
- Continental United States only (48 contiguous states)
Additional shipping fees may apply to:
- Alaska
- Hawaii
- U.S. territories (Puerto Rico, Guam, U.S. Virgin Islands, etc.)
- P.O. Boxes in certain locations
- Military APO/FPO addresses (case-by-case)
21.2 International Orders
International customers:
- Can sign up for the Founding Member Program
- Will receive tier assignment and loyalty benefits
- Free shipping does NOT apply to international orders
- Must pay standard international shipping rates
- Are responsible for all customs duties, taxes, and fees
21.3 Shipping Restrictions
We reserve the right to:
- Restrict shipping to certain locations
- Refuse orders to high-fraud areas
- Require additional verification for unusual shipping addresses
- Cancel orders we cannot fulfill due to shipping restrictions
22. TAX IMPLICATIONS
22.1 Potential Taxable Income
Birthday rewards, loyalty points, and other benefits provided through the Founding Member Program may constitute taxable income under IRS regulations.
You are responsible for:
- Determining if benefits are taxable to you
- Reporting any taxable benefits on your tax return
- Paying any taxes owed on benefits received
- Consulting with your tax advisor
22.2 IRS Reporting
If the total value of benefits you receive in a calendar year exceeds IRS thresholds (currently $600), we may be required to:
- Issue a Form 1099-MISC to you
- Report the value to the IRS
- Request your Social Security Number or Tax ID
We may withhold benefits if you:
- Refuse to provide required tax information
- Provide fraudulent tax information
22.3 We Are Not Tax Advisors
Important: The Dance Store does not provide tax advice. We cannot advise you on:
- Whether specific benefits are taxable
- How to report benefits on your tax return
- What deductions you may be eligible for
Please consult a qualified tax professional with questions about your tax obligations.
22.4 Gift Card Note
If you redeem loyalty points for gift cards (if this option becomes available), the gift card value may be considered taxable income to you.
23. PRIVACY & DATA USAGE
23.1 Information We Collect
To manage the Founding Member Program, we collect and use:
- Name and contact information
- Email address
- Purchase history
- Points balance and redemption history
- Birthday (for birthday rewards)
- Account activity and preferences
- Communication preferences
23.2 How We Use Your Information

- Manage your Founding Member tier and benefits

For Founding Members under 18:

You have the right to:
- Access your personal information
- Request correction of inaccurate information
- Request deletion of your information (account closure required)
- Opt out of marketing communications (transactional emails still sent)

24. DISPUTE RESOLUTION
24.1 Informal Resolution
If you have a dispute or concern about the Founding Member Program:
- Step 1: Contact us at support@dance.store
- Step 2: Describe your concern clearly
- Step 3: We will investigate and respond within 5–7 business days
- Step 4: We will work with you in good faith to resolve the issue
Most disputes can be resolved through this informal process.
24.2 Binding Arbitration
If we cannot resolve a dispute informally, you agree that:
- Disputes will be resolved through binding arbitration, not court litigation
- Arbitration will be conducted by the American Arbitration Association (AAA)
- Arbitration will take place in Orange County, California (or remotely if agreed)
- Each party pays their own arbitration costs unless law requires otherwise
- The arbitrator's decision is final and binding
24.3 Class Action Waiver
You agree to resolve disputes individually, not as part of a class action.
You waive your right to:
- Participate in class action lawsuits
- Join with other customers in multi-party litigation
- Consolidate your claim with other customers' claims
Arbitration will be conducted on an individual basis only.
24.4 Exceptions to Arbitration
The following may be pursued in small claims court instead of arbitration:
- Claims within small claims court jurisdiction (typically under $10,000)
- Claims seeking only injunctive relief
24.5 30-Day Opt-Out
You may opt out of the arbitration agreement by:
- Sending written notice to legal@dance.store within 30 days of joining the program
- Stating "I opt out of arbitration"
- Providing your name and email address
If you opt out:
- The arbitration clause does not apply to you
- Disputes will be resolved in California courts
- All other terms of this disclosure remain in effect
25. GOVERNING LAW
25.1 California Law Applies
This Founding Member Program Disclosure and any disputes arising from it are governed by the laws of the State of California, without regard to conflict of law principles.
25.2 Jurisdiction
If disputes are not resolved through arbitration, you agree that:
- Exclusive jurisdiction is in state or federal courts in Orange County, California
- You consent to personal jurisdiction in California courts
- You waive any objection to venue in California
25.3 Legal Compliance
We operate in compliance with:
- Federal Trade Commission (FTC) regulations
- Children's Online Privacy Protection Act (COPPA)
- California Consumer Privacy Act (CCPA)
- Payment Card Industry Data Security Standards (PCI DSS)
- Other applicable state and federal laws
26. SEVERABILITY
If any provision of this Founding Member Program Disclosure is found to be invalid, illegal, or unenforceable:
- That provision will be modified to the minimum extent necessary to make it enforceable
- If it cannot be modified, it will be severed from this disclosure
- All other provisions remain in full force and effect
Example: If the arbitration clause is found invalid in your jurisdiction, all other terms of this disclosure still apply.
27. ENTIRE AGREEMENT
This Founding Member Program Disclosure, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and The Dance Store regarding the Founding Member Program.
This disclosure supersedes any prior:
- Oral or written statements
- Marketing materials
- Social media posts
- Email communications
- Other representations about the program
If there is a conflict:
- This disclosure takes precedence over other materials
- Terms of Service take precedence over marketing statements
- Written terms override oral promises
